Property Registration in Egypt: Steps Under Law 9 of 2022

Property registration in Egypt explained: preliminary contract vs registered title, the documents you need, the 37-day decision period and resale pitfalls.

When lawyers talk about property registration in Egypt, they mean the step that transfers legal ownership of a unit to you and makes it enforceable against third parties; a signed preliminary contract only proves that a sale was agreed. Since the 2022 amendments (Law 9 of 2022), a registration request must be decided within 37 days instead of two years, and paying the real estate disposal tax no longer holds the registration itself hostage. This guide explains the three levels of paperwork Egyptian buyers meet, the documents you need, the steps in order, and the specific traps for buyers who purchase from abroad.

In short: Preliminary contract = proof of purchase. Signature validation = proof the seller signed. Registration (shahr) = legal transfer of title. Check the seller's own title first, prepare the official digital survey map and each party's identity and authority, and file at the Real Estate Publicity office covering the property's location. For compound and new-city units, ask early whether the developer's land and building are registered.

Three documents that are often confused

Most residential sales in Egypt start, and many end, with a preliminary contract (aqd ebtedai). Some buyers then file a signature-validation case (sehet tawqee) and assume they are done. They are not the same thing.

Document What it proves Transfers ownership? Good enough when
Preliminary contract The agreed sale, price and obligations between buyer and seller No — a personal obligation between the two parties During booking and instalments, before handover
Signature validation judgment That the seller's signature on the contract is genuine No — it does not rule on the sale itself Short-term protection against a seller denying the deal
Registered contract (Real Estate Publicity) Ownership recorded in the official register Yes, and it can be relied on against third parties Before resale, mortgage finance or inheritance planning

Why this matters to an expatriate buyer: when you eventually sell, borrow against the unit or pass it on, a registered title replaces a long, fragile chain of private contracts that every future buyer, bank and heir will otherwise ask you to explain.

What Law 9 of 2022 changed

According to Andersen Egypt's summary of the amendments, four changes matter most to buyers:

  1. Decision period. Registration requests are decided within 37 days rather than two years.
  2. Tax separated from registration. Paying the real estate disposal tax is no longer a condition that blocks the registration procedure.
  3. Fewer documents. The file is reduced to the personal data, capacity and authority of each party, plus an official digital map showing the unit's data and coordinates.
  4. Registration based on possession. New routes allow ownership to be established through settled possession for defined periods, without a complete ownership chain in every case.

The same summary notes prison sentences and fines for anyone who submits forged documents. If an intermediary offers to "sort out" a missing paper, walk away. The Real Estate Publicity and Notarization Authority publishes its own page on registration steps under the law; check it before you go, since procedures are updated. (The page was not reachable from our location when we wrote this, so we relied on the summary above for figures.)

How to register an apartment, step by step

Treat this as a route map. Each office applies the details its own way, so confirm with the clerk.

  1. Check the seller's title first. Ask for the original contract and proof of how the seller acquired the unit. If the seller holds an unregistered preliminary contract, find out who has to register first — registration builds on a prior title.
  2. Obtain the digital survey map. This official map fixes the unit's location and coordinates and is now the core of the application.
  3. Prepare identity and authority documents. National ID or passport for each party, and proof of their capacity: owner, attorney under a power of attorney, or company representative with a commercial registry extract.
  4. File at the competent office. That is the Real Estate Publicity office covering the property's district. Pay the fees and keep the receipt with its incoming number.
  5. Follow the request to approval. Once the file is complete it is entered in the priority register, and the statutory decision period runs from there.
  6. Sign the final deed and collect the registered contract. Keep a certified copy somewhere safe and share it with any bank you work with.

The government portal Digital Egypt offers several notarization and registry services online, including booking an appointment at a notarization office, which saves at least one trip.

Buying from abroad: the power-of-attorney trap

Many buyers in Riyadh, Dubai or Kuwait complete the purchase through a relative or a broker holding a power of attorney. That is common and workable, but the wording decides everything.

  • A management power of attorney does not let anyone sell or register on your behalf. A sale and registration power of attorney does. The clerk will read the text literally.
  • A power of attorney "to oneself and others" lets the attorney sell the unit to themselves. Only grant it to someone you would trust with the title.
  • A power of attorney issued abroad is normally done at an Egyptian consulate. Ask your local consulate what it currently requires, and keep the original until the registration is complete.

Primary vs resale: where registration gets harder

Buying from a developer usually means an off-plan or recently completed unit. Registration often waits until handover, and sometimes until the developer registers the land and the building. Before you sign, ask: is the land registered to, or allocated to, the developer? Does the contract commit the developer to help with registration after handover, and who pays the costs?

Buying resale means the unit may have passed through several private contracts since the developer first sold it. The longer that chain, the more important it is to collect every earlier contract and check names and areas match. In the new cities, the developer or the city authority may run its own transfer procedure, so ask about it before paying a deposit.

Mistakes that delay registration

  • Area mismatch. The contract area may include a share of common areas while the survey map measures the net unit. Resolve it before filing.
  • The last-instalment clause. Some developer contracts block transfer of ownership until the final payment. Know this on day one.
  • Accepting "it's registered" on trust. Ask to see the registered contract itself.
  • Brokers who never ask. A serious broker asks the seller about title and registration status before listing. We explain why in how to market a property, and how to put each party's responsibilities in writing in the real estate marketing contract guide.

How Buildoura helps

Buildoura is software for brokers and developers. It is not a registration body and does not give legal advice. What it does is support the transparency a buyer needs before this stage: a page for each unit or project with photos, floor plans and unit pricing, search by budget, area and location, and a WhatsApp button to reach the seller's side directly.

For the broker, the CRM keeps every buyer's notes and stage in one place, and the reservation and contract handoff stay visible after the buyer says yes, so paperwork questions are not lost between calls.

FAQ

Is property registration in Egypt mandatory?

Nothing stops you from relying on a preliminary contract, but ownership does not formally transfer, and cannot be relied on against third parties, until the contract is registered. The difference shows when you sell, mortgage or pass on the unit.

How long does registration take after Law 9 of 2022?

The amendments set a 37-day decision period instead of two years. The clock effectively starts once a complete file is entered, so missing documents remain the main cause of delay.

Does a signature validation judgment replace registration?

No. It confirms the seller signed the contract; it neither transfers ownership nor rules on the sale itself. It is useful short-term protection, not a substitute for registration.

Can I register a property in Egypt while living abroad?

Usually yes, through an attorney holding a power of attorney that expressly covers sale and registration, typically issued at an Egyptian consulate. Check its wording carefully and confirm the consulate's current requirements.

Can I register an off-plan unit before handover?

Generally not until the unit is complete and the developer's land and building can be registered. What you can do is make sure the contract commits the developer to support registration after handover and states who bears the cost.
